1. Introduction
These Terms and Conditions (“Terms”) govern your enrolment and participation in the IAA Level 1 Immigration Adviser Training programme provided by James Immigration Solutions Ltd (“we”, “us”, “our”). By enrolling in our course, you agree to be bound by these Terms.

2. Nature of the Training
2.1. Educational Purpose: This training is strictly educational. It is designed to prepare learners for the IAA Level 1 assessment and to promote safe, compliant practice. 2.2. No Automatic Authorisation: Completion of this training does not grant you authorisation or a license to practice as an immigration adviser. Authorisation is granted solely by the Office of the Immigration Services Commissioner (OISC) or the Immigration Advisers Authority (IAA) after you pass their official assessment and apply for regulation. 2.3. No Legal Advice: The content provided during the training, including study packs and live discussions, is for training purposes only and does not constitute legal advice for specific cases.
3. Enrolment and Payment
3.1. Booking: A place on the course is only confirmed once full payment has been received. 3.2. Fees: All fees must be paid in GBP (£) via bank transfer or the agreed payment method prior to the start of the course. 3.3. Study Materials: Access to the soft copy study pack is released only after payment is confirmed.
4. Cancellation and Refunds
4.1. Cooling-off Period: You have the right to cancel your booking within 14 days of payment (“cooling-off period”), provided you have not accessed or downloaded the digital study materials or attended any part of the course. 4.2. Digital Content Waiver: By downloading or accessing the digital study pack sent to you, you acknowledge that you lose your right to cancel and request a refund under the Consumer Contracts Regulations. 4.3. Cancellations by You:
- More than 7 days before the course: Full refund (minus any administrative fees) or transfer to a future date.
- Less than 7 days before the course: No refund. We may, at our discretion, offer a transfer to a future date. 4.4. Cancellations by Us: We reserve the right to cancel or reschedule a training session due to unforeseen circumstances (e.g., instructor illness, technical failure). In such cases, you will be offered a full refund or a transfer to the next available date. We are not liable for any consequential losses (e.g., time off work).
5. Intellectual Property (IP)
5.1. Ownership: All training materials, including slides, handouts, study packs, and recordings, are the intellectual property of James Immigration Solutions Ltd. 5.2. Usage: These materials are for your personal use only. 5.3. Prohibitions: You must not copy, share, resell, distribute, or publish any part of the training materials without our prior written consent. Unauthorised sharing may result in legal action.
6. Conduct and Professionalism
6.1. Live Sessions: We expect all participants to behave professionally during live Zoom/Teams sessions. 6.2. Removal: We reserve the right to remove any participant from the training without refund if they behave in a disruptive, offensive, or unprofessional manner.
7. Limitation of Liability
7.1. Accuracy: While we make every effort to ensure our training materials are accurate and up-to-date with current immigration rules, the law changes frequently. We accept no liability for errors or omissions. 7.2. Exam Success: We do not guarantee that you will pass the IAA/OISC assessment. Success depends on your own study and understanding. 7.3. Professional Indemnity: We are not liable for any advice you provide to third parties after taking this course. You are responsible for ensuring you are properly authorised and insured before giving immigration advice.
8. Data Protection
We process your personal data in accordance with our Privacy Policy. By enrolling, you consent to us using your data to administer the course and issue your certificate.
9. Governing Law
These Terms are governed by and construed in accordance with the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
